You're right, the SCOTUS decision, as it stands, remanded the remedy back to the FSC with two hours to go before the deadline and said in effect, "gosh, look at the time"

But we can never know what SCOTUS would have done if the FSC-ordered recount had begun 10 days earlier. I keep remembering Scalia's wording of the stay, when he said the recount "would cast doubt on the legitimacy of Bush's election". It gave me the impression that they would have found some other reason to stop it if the calendar hadn't been convenient.
