Typically, any important decision has to be signed off on by an Assistant Secretary in a USG department. However, the Bush crowd did not have time to pick and get their Assistant Secretary crowd approved. So you may have career Justice people at the Deputy Assistant Secretary level running their particular bureau within the department.

In that case, it is unlikely they would sign off on a major merger until somebody in the new political appointee food chain is on board.

All of the above is strictly speculation based on my experience with another government department, not Justice.
