As for school desegregation, I'm sure that if Scalia, Renquist and the crew had been on the Court in 1954, they would have been in the minority in Brown v. Board of Education (and no doubt AG Ashcroft would have submitted a brief in support of the State). I also doubt that they would have much problem saying it's ok for school to teach creationism. They are federalists, they have strongly trended toward state's rights in recent years, and the election case was totally out of synch with those opinions.
