Do you know how difficult it is to build that type of a case? At this point in time, it's a free for all.

Additionally, I didn't try to imply that an applicant's representative(s) would use fraud to obtain a patent. Simply, the applicant(s) may not use the term W-CDMA. In fact, they may not use the term CDMA at all.

my quick survey was just a note that WCDMA has not really taken hold of a large amount of IPR.

Did u do a search for the term "WCDMA" on the PTO's web site? If so, I would limit the search to two classes (Class 455, 370). As i recall, 455 are wireless implementations and 370 is channel coding. That's where most of the IP will reside and then I would search for either assignee or for CDMA or term used to implement CDMA.

That would probably be the best way to determine how much IP Qualcomm's competitors have.

By the way, is Dickinson leaving b/c of GWB? I wonder who his replacement will be....
