I agree that Bush won before the USSC either way. What I have been objecting to is the false notion put forth by right wingers here and elsewhere that a deeply divided court was less divided than it appeared to be. 7-2 makes it sound like there was real consensus on the core issue -- when it is patently obvious to anybody who hasn't fallen under the spell of right wing pods from outer space that (i) there wasn't anything close to consensus on any issue, and (ii) the majority decision was motivated as much or more by political considerations than fidelity to conservative principles of legal interpretation.
