Because if you do the recount fairly, there is no violation. Both the majority and dissent on the Bush V. Gore case have said this.

That completely evades the question. The equal protection problems of the recount were simply dwarfed by the equal protection problems of the original vote, which Bush vs. Gore never addressed. However, if one tries to apply the law with any logical consistency, they ought to be addressed.

BTW, if you missed the scathing Q & A on the Bush vs. Gore decision that Mr. Palau posted on this thread a couple of days ago, have a look. I'll be curious to hear your reaction.
