You asked why do we have to wait for the recount before declaring that a violation of the equal protection clause has occurred? That is the basic question.

I answered. So did SCOTUS.

The equal protection problems of the recount were simply dwarfed by the equal protection problems of the original vote

They addressed that too. The answer is an unequivicol no. Both Majority and dissent.
