The sticking point in the opinion between the 5 who stopped the recount and the 2 who agreed that the recount without standards was unconstitutional but wanted to remand for a recount with standards was whether or not Florida could have completed a constitutionally sound recount, including all appeals, before December 18.

I have been looking forward to intelligent analysis by legal scholars and well-informed journalists addressing the issue of what would have transpired in Congress if the recount was NOT completed by December 18, because it is completely uncharted waters. So far I haven't seen really trenchant scholarship on the issue - the Democrats keep saying "Gore won!" and the Republicans keep saying "All the votes were counted!"

Eventually there will be some, I hope.
