Just lurking and read your question. I researched this one a couple of years ago..
The law says you can't buy it in any account that you're related to. This seemed to include IRA's, trusts, custodian accounts, power of attorney, and relatives. I remember that there wasn't a clear definition of relatives. Can't remember where I read this, but it was very specific. Maybe the extended instructions for schedule D?
Also, a receiving a gift or inheritance of the stock would not cause a wash sale to occur.
