To me, saying it's too hard to find the precise place to draw it so let's use birth isn't convincing.

Legally speaking, I think it is. We have no established default for breathalizers. For millennia we've had birth as the bright line for when human life begins. Our Declaration of Independence and Constitution are based on birth. If we were establishing something from scratch I'd agree, but we're talking about changing something long established in common law and in our country's law. Just because we've always done it that way doesn't mean we have to keep doing it that way, but when something is already established, it sticks until there's a compelling reason to change it and a workable way to implement the change.

The distress of nurses is a different issue than the legality of abortion. Just because something is legal doesn't mean all members of a profession should be required to do it.

How would you set things up?
