Without getting in to the level of small details (or getting into my ideological biases against such controls) two things still concern me. 1 - What about exchange rate fluctuations. If the drugs are cheaper in the US but the dollar gets stronger, in the short run the price might not change. This would result in the dollar price being equivalent to a larger amount of pounds, euros, yen, ect. and all of the sudden being more. The only ways around this that I can think of is that either the law allows prices to be a little bit more in the US or allow prices to be temporally higher or companies could be forced to keep prices in the US much lower to guard against such fluctuations. The other problem I have is that it might cause reduced incentives for research for new drugs.

Also how would you measure the price. It is quite possible that wholesale prices vary depending on the size of the wholesale purchase and who is making the purchase. If you find any wholesale sale in another country that is cheaper then any sale in the US is the drug company in violation of the law? What about if it is a French drug company that sells direct in France but sells to a distributor in the US. Would the price to the distributor count, or the price the distributor charges its customers?
