There is no legal basis that I can think of for defining a fetus as a person that deserves rights, nor is there any that I can think of that would define it as not a person other then the Roe vs. Wade case (and that doesn't really address the issue strongly either, it just asserts that a woman's right to privacy gives her a right to an abortion). I'm not sure how the question about a legal basis is relevant. If the law said fetuses did have full human rights would you stop supporting a right to an abortion? If the law said 6 month old infants had no rights would you all of the sudden think it was ok to kill them? I don't see how discussions about what the law should be can be decided by figureing out what the law currently is.
