Regardless of who posted the actual link, the real morons here (in addition to the idiots that were driving the car) are the Home Depot employees (if the story is true as written) that actually loaded that vehicle in a manner that made the vehicle unsafe for public roads, and therefore exposed Home Depot to a liability lawsuit. Just imagine if that driver had lost control of his car, crossed into oncoming traffic, and maimed or killed some innocent third party and maybe some children as well. Home Depot wouldn't have a snowball's chance in Hades of defending a lawsuit like that. Even a first year law student knows that one person cannot subrogate another person's right to sue merely by signing a waiver, conditional or otherwise. At absolute best, the waiver might have protected Home Depot against being sued for damages caused to the buyer's vehicle, and even that is questionable, as in this case, Home Depot employees would be judged to be the "experts" in this area (of properly loading a vehicle), and yet they knowingly allowed this unsafe vehicle on the roads... Unbelievable... What were they thinking at the time?

PS - As a potential shareholder of Home Depot (maybe someday, who knows???), I felt so strongly about this that I wrote an e-mail (including the link) to Arthur Blank, Home Depot's CEO. We'll see if I get a response other than a mere acknowledgement of receipt... |
