I've tried making this point before. The big issue is the magnitude of the royalties. The DRAM manufacturers believe that Rambus is seeking royalties way out of line with any contribution they may have made.

In any kind of efficient world, and believe it or not the courts are a fairly efficient mechanism for bringing divergent valuations to a common point, there should be settlement pressure to get the deal done. Rambus can't afford to lose since its patents are its primary asset and Infineon can't afford to lose because the royalties are, as you say "way out of line". (I don't know if that is true - a matter of perspective, I suppose).

So, can't reasonable people cobble up a deal here? My bet is they can.
