Does the wash rule apply only when there is a capital loss? Also does the rule apple when the short sale date is over 1 year after the original stock purchase.

Let me be more specific. Stock was bought over a year ago, hence there is an unrealized long term capital gain. A short sale is made against the box, then covered. The net result is that the original shares have been kept. When I sell these shares in the future, would I still be able to book the full long term capital gain.
