Regarding the recent discussion on nok phones with qcom chips inside.

I had an email discussion with IR Nokia USA and this is what they said. Feel free to post it on SI.

To whom it may concern:

According to a recent press release:

"The world's largest mobile-phone company is close to finalizing a large-scale contract to sell mobile phones to Verizon."

I have a couple of questions that I'm hoping you can clarify for me.

1) Currently, cdma phones can be purchased from Verizon, is this different than what Nokia is currently negotiating?WE DO NOT DISCUSS ANY NEGOTIATIONS THAT HAVE NOT BEEN MADE PUBLIC, BUT YOU ARE CORRECT THAT YOU CAN NOW PURCHASE CDMA HANDSETS FROM VERIZON.

2) The phones that are being sold have a "licensed by qualcomm" sticker. Does that mean it's a nokia produced asic or is it a telson produced asic?, which may mean it would have a "digital by qcom" sticker.NO WHERE ON A NOKIA PRODUCT WOULD THERE BE A "LICENSED BY QUALCOM" STICKER. NOKIA DEVELOPS ITS OWN CDMA CHIPSET. ANY ROYALTY PAID TO QUAILCOM WOULD BE ON THE VERY BASIC IPR LEVEL AND WOULD NOT REQUIRE A MENTION ON THE PRODUCT. WHAT YOU MIGHT SEE ON OTHER MANUFACTURER'S PRODUCT IS A CO-BRANDING AGREEMENT, BUT WE DO NOT DO THAT. THE AGREEMENT NOKIA MADE WITH TELSON IS FOR THE KOREAN MARKET.

3) Can you eloborate on Nokia's third generation strategy?NOKIA'S 3G STRATEGY IS TO BE THE LEADER. WE AIME TO OFFER THE MOST COMPREHENSIVE PRODUCT PORFOLIO IN TERMS OF BOTH INFRASTRUCTURE AND HANDSETS. WE ALSO PLAN TO OFFER THE MOST INNOVATIVE SERVICES. NOKIA SUPPORTS WCDMA AS THE 3G STANDARD. WE HAVE ANNOUNCED SEVERAL 3G CONTRACTS ALREADY. IF YOU HAVE ANY MORE SPECIFIC QUESTIONS, I WOULD BE HAPPY TO ELABORATE WHERE POSSIBLE.

EMAIL #2

Your friend is mistaken and I would be happy to speak with him. As far as a license goes, Nokia and other equipment manufacturers do not need to have a license in order to develop 3G technology. There are two different licensing issues at hand.

1) the operators have to purchase a license in order to offer 3G services, as the new technology--WCDMA will operate on a different frequency spectrum,

2) I think what you are asking in regards to Nokia, is that several manufacturers have signed licensing agreements with QualComm in regards to their patents. Nokia has a license agreement with QualComm which covers our current businesses. It is natural that the parties have discussions also concerning future businesses. Such talks usually take time and we have not seen any particular urgency here. Nokia also has a competitive and strong patent position in all 3G technologies and thus there is no significant influence to our bottom line. WCDMA and other ITU 3G technologies is a result of international standardization where many more companies have participated and have essential patents (including Nokia) Nokia's position is that the cumulative royalty level should become lower and thus all patent holders should award licenses on fair and reasonable terms.
