Uh, sorry, not quite.
"I will kill you" is not yet assault.
It has to be combined with some physical act which indicates a reasonable apprehension of imminent fear of bodily harm.
Amazingly, if I simply say to you "not today, not tomorrow, but some time in the future, I will kill you" without any physical act of any kind, even if you are absolutely convinced I will indeed kill you, it is not assault. It is a threat, which may be harrassment or something else depending on the circumstances, but it is not assault. (It may, however, in some jurisdictions be domestic violence assault if we are domestic partners, which isn't assault under the common law or criminal law but is a separate offense which borrows, perhaps liberally, the term assault.) |
