Either they would have to reveal their plans, or issue a "no comment" which would then be the same as saying "we are in discussions", because of the precedent they had set now.

In such a scenario, why not just tell the truth? What would be so bad about admitting to being in takeover discussions if it were the truth? I can see no advantage in deception.
