Sorry I missed the joke. But, I still contend that what Greg thinks should happen simply can't happen in real life. Since even approximation of equality on such an important issue won't happen in reality, then it should be not be used at all because it will be applied non-uniformly.

This argument particularly applies for the death penalty because of the sheer gravity of this ultimate punishment. I think that type of inequity is just unacceptable when committed by the State. Other first world countries have abolished the DP. This unequal treatment argument could of course be used on the criminal justice system in general (rich people get probation, poor people get time).

I don't think "punishment" of crime (by putting people in prison) has been demonstrated to be effective in preventing crime (except for the duration of the incarceration by those individuals). If you were submitting the "treatment" of the disease "crime" to the FDA and only had the statistics we had for incarceration, then prison as a treatment would never have been approved.

It is time we segregate property and vice crimes from violent crime and treat them differently. The motivations and mindsets are different. I would promote a national service program where youthful offenders of minor crime could provide international service in lieu of community service. Training would be provided as an incentive. I don't mind paying for programs that work. The way to find out if it works is to do a pilot program.
