I shouldn't step into this, but what the heck:) Problem is the person giving out the punishment is an unbiased, rational person. Not.

But when you put a mandatory sentence on someone that doesn't work either. We were talking about our insane war on drugs on a different thread. We have pot smokers (I know it's illegal and no I don't smoke nor inhale) who can get a mandatory sentence for 15 years because of a second offense. That's nuts.

I guess I am agreeing with you in that neither argument works without sane, rational people running the show.

Perhaps I should be a judge:)
