Nortel is a very big client on the JDS roster of customers. I do not see JDS proceeding with this
case, although it is possible. As well, it is extremely difficult to prove that there was an intent to
defraud regardless of how evident it appears after the fact.

I am not taking sides just commenting in general terms on the situation.
