New World Telephone, PCCW Dispute Reaches Court of Appeal

New World Telephone, a unit of New World Development Co. (0017), said the Court of Appeal will be asked this week to rule on its application for the determination of various points of law in its dispute over the payment of delivery fees with PCCW-HKT, the local telephone unit of Pacific Century CyberWorks (0008).

The claim relates to the payment of delivery fees on incoming international telephone calls between January 1997 and October 1998.

In essence, NWT said its position is that it is entitled to receive the delivery fees because it was the interconnection between PCCW-HKT's international gateway and NWT's local fixed-line telephone network that provided the basis for payment.

NWT said it will ask the Court of Appeal to rule on several points of law central to the litigation. This follows a decision by Justice Stone at the Court of First Instance in April 2000 not to rule upon the points of law raised by NWT before a full trial of the action in the Commercial Court.
