I am not sure I understand your point correctly, Richard.
To the best of my knowledge there isn't any accounting time limitation, but I'm not certain.

As for a going concern statement. Depends on 4th quarter cash burn. The little bit ADS earns or loses shouldn't change that math much, and the arithmetic is beginning to get kind of tight .

I am by no means trying to predict doom, but if the fourth quarter held a hefty loss, and none of the possible financial maneuvers to shore up the balance sheet have taken place by the time the K arrives, it could be even a little bit scarier than ususal.
