Cobalt: one of the biggest problems with the anit-SLAPP statutes is recognizing a lawsuit as one. In the Varian v. Delfino SLAPP the first complaint listed criminal claims (since dropped), a Federal Lanham Act violation (since dismissed) and several other claims that made it difficult to see the Varian SLAPP for what it was:

It would be great if the Plaintiffs would say, hello, guess what? I'm filing a SLAPP against you so now you know to go get the proper protection. That is why the www.johndoes.org and this thread are so useful and why I "post like a bunny" about the Varian SLAPP so that hopefully there is a ground-swelling of knowledge that develops out there.
Also, I think SLAPPers can find so many ways to avoid getting caught under the anti-SLAPP statutes. I believe the best solution is that places like Yahoo!, Raging Bull, etc. not store IP and email addresses and other traceable information that can then later be subpoenaed, legitimately or otherwise.
