You got it wrong partner, hearsay is defined as "an out of court statement offered for the truth of the matter asserted" there are a dozen exceptions to the hearsay rule that permit its admissibility anyway... also, a statement may be out of court and still not be hearsay, Lesson 1: A case of assault. A nurse testifies that the victim while looking in the mirror at her bruises says, "my husband should have been a boxer"... this is not hearsay because it is not being offered for the truth of the matter asserted (whether or not her husband should have been a boxer) but instead is being offered to prove that her husband was the attacker. be careful before you give out legal advice dude.
