If JEDEC had knowledge of Rambus IP, and Rambus reasonable expectations regarding such IP, during the deliberations I don't see how they can support a defense that Rambus "led them on" or "tricked them" or "used deceit" (my paraphrasing).

I really wonder if what will come to light in all of this is that nobody was tricked, surprised or misled. Rambus had certain IP rights and was perfecting them. JEDEC really didn't want to go that direction if it could help it, but it ultimately couldn't. Nothing needed to be said or written down to provide Rambus with a powerful argument here.
