I guess you haven't been listening to the Appeals Court Judges questioning of the US Govt. lawyers. I you had you know why Microsoft is up today.

At one point Chief Judge Edwards said:

"I'm not in the camp that says just be because the District Court found something in his findings that we can believe it to be a fact, because I don't see any factual support for much of his findings"
