If I am not mistaken, I believe that new patent rules dictate that
patent cases are no longer decided by jury, but by the judge in charge
of the case. The number of lawyers are confusing however because
it only takes one judge's decision on any of several complaints to disqualify the patent in regard to that particular complaint. I suppose
that this could be appealed to a higher court if necessary. However I think that what these lawyers are really going after is the legality of the premise of the entire patent to disqualify it, i.e. too general, prior art, etc. .
