I listened to the MSFT trial tapes and I have to say that the government had the weaker hand. Not only did the judges make it very clear that they did not see how Netscape was "shut out" of the market when 80 million downloads occurred during the time in question, but they even brought up a point about AOL that surprised me. A judge pointed out that AOL, who now owns Netscape, is doing the same thing MSFT did - they are downloading their browser onto the computers that run AOL and preventing other browsers from running.
They didn't follow it too far (because it is sort of off the topic) but it was clear they have thought about it. The point is this: Once you fire up AOL and you click on a url link, AOL automatically fires up the AOL (Netscape) browser and keeps your eyeballs captive as you watch the web. It is theroretically possible for you to use IE5 but very difficult. You would have to fire up IE5, copy a url to clipboard, and go paste it in the browser. Nobody is going to do that. They are just going to click on the url. So Netscape (AOL) is doing the same thing right now with their 26 milion subscribers that they sued MSFT over.

They don't call it the walled garden for nothing.
