They may throw the case out today. The judges are shocked at the judges behavior, especially since the government lawyer Robert said the gov had no defense, but then Roberts added that the Judge had imposed an embargo and he did start defending Jackson and really enraged the Judges, especially Chief Justice Edwards.

They asked why Microsoft didn't ask for reversal or recusal before based on his comments. The comments didn't come till after the remedy hearing.

Chief Justice Edwards got angry; The system would be a sham if judges went around saying things like Jackson said: referring to Microsoft executives as gangster..."We just don't do that".

He was allowed to make comments based on what he learned during the court procedures; but the inflammatory statements released after the trial (but possibly made during the trial) referring to Microsoft executives as "gangland killers" gives the public the appearance of impropriety and bias. The judges don't like this at all.
