I don't think you can play that game

<<Additionally, is LMNE different enough of a stock than MRVC for Uncle Sam in regards to buying a like or similar stock and and claiming a lose or gain>>

A wash sale occurs when you sell stock or securities at a loss and within 30 days before or after the sale you buy or acquire in a fully taxable trade, or acquire a contract or option to buy, substantially identical stock or securities. I seriously doubt that the sell MRV and buy LMNE strategy would pass muster with the IRS. Hell, as we have all painfully realized MRV is LMNE as far as the market goes. As we speak LMNE market cap is $877.5m and MRV is $878.5M.

"If two different stocks are linked together in such a way that any change in the price of one will be reflected in the price of another, they're likely to be treated as substantially identical securities for purposes of the wash sale rule" See section titled Playing games. fairmark.com

As we all know LMNE and MRV stock prices track each other closely.

I am not an accountant but common sense suggests that this one is not even a close call.
