It seems most people miss the point of all the Napster litigation. The main point is not the piracy itself. The main point is other companies ability to PROFIT off of piracy.

Napster's business model is/was based on faciliting people to steal copyrighted material. From there, Napster would display ad banners and/or offer subscriptions. You cannot easily stop the piracy, but you CAN stop the PROFIT.

If a legal precedent is set that there is no $$$ real money to be made, the piracy will remain small, as those with the $$$ means will not invest in this business. All of the operations will remain small.

*Gnutella and Bearshare and the like are a NIGHTMARE to use. Napster made it incredibly easy as everything was organized and easy to set up and find for the average person. Peer to peer like Gnutella just doesn't work for the average person. it is extremely difficult to set up and even harder to find a working download that doens't crap out on you half-way through..
