Yes, of course. But the ruling does blunt the initiatives of those who have challenged every attempt at reasonable regulation by misusing the cost argument. They have added a lot of overhead of their own by obfuscation and delay. Perhaps their efforts can now be directed at a more constructive tactic.

I agree with Tim that there are environmental zealots who would spend unlimited dollars on efforts of questionable importance. There is also the above bunch who resist all efforts to protect the environment. May both extremes get a life!
