01/070 Queensland man pleads guilty on spam charges
Wednesday 7 March 2001

Wayne John Loughnan, of Noosa Heads in Queensland, today pleaded guilty in the County Court of Victoria to three charges brought by the Australian Securities and Investments Commission (ASIC).

Two of the charges relate to Mr Loughnan making false or misleading statements that were likely to induce the purchase of securities of Rentech Inc, via spam email and through placing email messages on Internet Bulletin boards operated by Raging Bull Inc. and Yahoo Inc.

The third charge relates to Mr Loughnan's interference with, interruption of or obstruction of the lawful use of computers operated by ten unrelated third parties.

The charges follow an ASIC investigation into emails and web site postings transmitted in May 1999 in relation to the stock of US company Rentech Inc, which was at the time listed on the US NASDAQ exchange.

ASIC began its investigation after receiving information from the U.S. Securities and Exchange Commission (SEC).

The matter has now been adjourned to 22 May 2001 for sentencing in the County Court of Victoria.

This matter is being prosecuted by the Commonwealth Director of Public Prosecutions
