FALCON: In other words, did you have in your mind that this would be a way of getting back or retaliating against Mike Delfino by bringing up these old past matters in a declaration, dated, I believe, in February or March of '99 -- March of '99? FAIR: I don't recall that feeling. FALCON: Well, you knew how this declaration was going to be used at the time you signed it, did you not? POPPE: Objection, vague. FAIR: I'm not sure I still know how it's going to be used. FALCON: Well, you saw the caption on the cover there that says Varian Associates is the plaintiff, Michelangelo Delfino is the defendant. So you knew that Varian was going to sue Delfino, did you not, when you signed this? WIDMANN: Keep on going. I am going to get something from my office. FAIR: I think I did. FALCON: And up at the first paragraph, it says -- you make this under your own personal knowledge in support of an application by the plaintiffs for preliminary injunction. So you knew that they were going to ask that an injunction be granted preliminary in the case, did you not, when you signed this? FAIR: That's what it says. FALCON: So when you were asked to sign this declaration, did you understand that it was going to be used in a lawsuit to try and restrict Mike Delfino from posting on the Internet? FAIR: I don't think I knew exactly how it was going to be used. FALCON: Did you care how it was going to be used?
