this is very much different than the FUD that went on all day today. There is no ulitmate ruling of fact and law. There is no sumary judgment against RMBS. All that happened was a pre-trial motion to exclude evidence which rmbs lost. "an unidentified source" says that the judge agrees with Inf.'s expert. First, unless this judge didn't learn anything from the conduct of the judge in the msft trial, i doubt he has stated his beliefs to anyone. Further, if the trial hasn't started yet, then Inf's expert testimony hasn't all been heard. all that has been heard is enough for the judge to decide whether the testimony on the particular subject the expert was to testify on will be admissible at trial. FUD FUD and more FUD. Rmbs may lose. But it now doesn't appear that anything really happened yesterday.
