Hi ekid; Actually, the three memory makers are suing on the grounds that (1) the patents are invalid, and (2) if the patents had been invalid, then Rambus would have had a duty to disclose them. They won on part (1), so now they need only use part (2) in order to increase the damages. -- Carl
