Concealing information has been an issue, but releasing it (which is what violating a Non Disclosure Agreement, or NDA, involves) has never been an issue. I think the rambus longs are getting way ahead of themselves. It's hard to blame them, though, since a glint of hope in the middle of such a dark night must be quite a treat. Infineon had two defenses, a primary one (the prior art claim) and a secondary one (the JEDEC defense). These latest reports sound negative for the JEDEC defense, but they do nothing about Infineon's claim that all art in SDRAM and DDR that are similar to art in RDRAM are based upon art prior to Rambus.
