Can someone help me on a tax question - I was wondering if daytraders have to file their income or loss as business income or can they file and the profits are considered capital gains. I don't know as much on this topic and i filed a form T123 last year to declare that all property that i dispose of was capital property. Last year, they let me go under capital gains but this year, i have done a lot of daytrading transactions and am worried that they could tax it as business income.
