I've seen similar parsings. Interesting stuff. Previous rulings my the SC seem to interpret it the other way; see some of my previous postings. I guess that is the heart of the debate; interpretations of the wording, and the intent. Maybe some day the SC will give a definitive interpretation, but I think they'll avoid that like the plague.
