Ken- I think the media is completely missing the significance of lifting the ownership caps rule.

Side note: For those that don't know, currently the FCC allows any single MSO(cable company) a maxiumum market share of 30% of the total market.

Since a federal court has ruled the ownership cap rules unconstitutional, the FCC has the option to fight the ruling or go along with it. I'm of the opinion they may go along with it (thanks to a new FCC appointed by Bush).

Therefore ATT is not forced to sell cable subscribers anymore. On the contrary they may even move up their number of subscribers via other MSO purchases. This is what Armstrong was screaming for to no end while ATT was buying up $100 billion worth of cable companies. Now he may finally get his wish.

I'm hoping that Armstrong will back away from splitting up ATT and move ahead with the plans he started about 1-1/2 years ago. DIRECT access to their LD customers via cable telephony. It made a great deal of sense when he proposed it. I still think it makes sense today.

If ATT does indeed think the FCC is clearly on their side, they may just start up the capex again. This would cause a great deal of angst among the ILECs and they would start their cycle of capex too.
