I think you are still slightly missing the point WRT Napster. No one was making money because RIAA wasn't interested in making money on it. The entire RECORDING industry business model is based on the sale and distribution of the $18 CD.

Like Boise says in the brief...

By repeatedly refusing Napster's offers of a reasonable license and opposing a compulsory license, they have demonstrated that they are not seeking to be appropriately compensated, but rather to kill or control a technology they view as competition."

As with all disruptive innovation, someone is going to lose, and in this case lose big.
