Arcane, let me be a bit more speculative here. If a message board participant can be sued for falsely alleging a lawsuit against a company, then it should hold true that a company can be held liable for falsely alleging they are suing a message board participant.

The only caveat here is that the person being threatened can't be using an alias because, as far as I know, you can't libel an alias. However, I suppose shareholders and the SEC could sue the company for issuing a false and misleading press release in an attempt to stifle someone with legitimate concerns about it no matter what name they posted under.
