Thanks for that post, Karl, even tho' it is doubtful I'll be a part of any class covered by this reversal of legal decision mentioned in your timely post---I made, not lost money, on the Bre-X shares part of my BreSea portfolio. However, I do have a "few" shares riding on the outcome of the BreSea financial receivership and new BoD chosen at an an extraordinary shareholder meeting called and convened in Feb 2001.
What I wish that article did was give the reason for the judges reversal. All along, the Yetter team --legal firm in Texas handling this matter-- has basically maintained it was primarily an exercise in getting the paperwork just right before they prevailed. Sounds like they're making progress on that front, eh?
Our Canadian friends have long enjoyed a "damn near impossible to bring a class action suit successfully" environment up there far too long in my opinion. Something has changed, and it is an important change. Maybe the biggest change is that the deep pockets have have time to beef up reserves, which of course, must be set aside out of earnings in the intervening years since Bre-X was ignominiously brought down by greed. These guys and gals have to know it was too good to be true to rely upon being excluded forever...they were just in this too, too deep---like up to their greasy necks and too many investors who wanted to wring those necks<g>
