B. Former Cardholders

The Bank will send, to the last known address of each Former Cardholder identified
by the Bank’s ordinary computer business records, a Settlement Class New Account offer
with an Introductory Rate that is 1 percentage point lower, and lasts three months longer,
than the Introductory Rate in the Bank’s Champion New Account Offer. However, under no
circumstances will Former Cardholders receive an Introductory Rate lower than 1.9%. If
the Champion New Account Offer has an Introductory Rate of 1.9%, Former Cardholders
will be sent a Settlement Class New Account Offer with an Introductory Rate of 1.9% that
lasts six months longer than the Introductory Rate in the Bank’s Champion New Account Offer

A. Current Cardholders

The Bank will send, to each Current Cardholder identified by the Bank’s ordinary
computer business records maintained for such purpose, a Balance Transfer Offer as
specified below.

The Bank will send, to each such Current Cardholder who meets the Bank’s credit
standards for its Champion Balance Transfer Offer, a Settlement Class Balance Transfer
Offer with an Introductory Rate that is 1 percentage point lower, and lasts three months
longer, than the Introductory Rate in the Champion Balance Transfer Offer. However,
under no circumstances will Current Cardholders be offered an Introductory Rate below 2.9%.
If the Champion Balance Transfer Offer has an Introductory Rate of 2.9%, Current
Cardholders will be sent a Settlement Class Balance Transfer Offer with an Introductory Rate
of 2.9% that lasts a total of six months longer than the Introductory Rate in the Bank’s
Champion Balance Transfer Offer.

The Bank will send, to each such Current Cardholder who does not meet the Bank’s
usual credit standards for its Champion Balance Transfer Offer, a Settlement Class Balance
Transfer Offer with an Introductory Rate that is 5 percentage points lower than the average
Rate being charged to this group of Cardholders.

Some Current Cardholders will receive a .6 percentage point reduction in the Interest
Rate charged on credit card balances otherwise subject to the contractual Rate for purchases.
This benefit will be provided to Current Cardholders who:

(1) have not made a late payment twice within six months;

(2) have an above average credit score, as specified in the settlement agreement; and

(3) do not accept the balance transfer offer described above.

The Rate reduction will not automatically end. However, an individual customer’s Rate
will be subject to change provided that any such change is applied to similarly situated cardholders.



i have one active (but a wingspan) card. i'm not sure if this settlement will apply to the wingspan card.

i filed all seven closed cards in the proof of claim stage.
