See your CPA or tax attorney for the real answer but everything I have read on the Wash Sale Rule would indicate buying stock in a different, unrelated company in the same sector will not cause one to run afoul of the rule. Now, if you sold the stock and bought warrants or some other convertible security for the same company, you would have problem.
