Tejek, I think there is a 90+% chance it was spying on China from above international waters. Assuming this is true there is a greater then 50% chance China is at fault because they have more reason to want to stop the activity of the plane then we would to take out a Chinese fighter and because the fighter is a lot more in control of the situation then our relatively slow, lumbering, unarmed plane was. Observing China is not an illicit activity if we didn't violate their air space to do it.
