MP3.com is obviously supporting the leading format. Real has been trying to subvert for a long time, as others have - like Apple's Quicktime and MSFT's poor attempts, too. Right now MP3 format is too big to stop. Just look at the players/encoders on the market - even Real's player doesn't do it. There's plenty of time for MP3.com to adapt.

What makes MP3.com an up and coming company is its music management system and its artist base. BTW it could also develop, as it seems to be, into a feeder label through its licencing program. In other words, becoming the music industry's leading farm system.

If the industry goes proprietary on the majors, as seems likely due to Napster, MP3 will attact labels to it because of its technology & delivery system. I see the delivery mechanisms going to 4-6 major players all aligned with majors under cross licencing deals. I think MP3.com will be one of them.

And hey, as the lawsuits abate - what about the reserves? They will have to get released back to earnings as extraordinary items which will have dramatic EPS impact.
