Damages in excess of $50 MILLION. According to Clyde Pearce, Bayh and Connaughton`s lead counsel for Metalclad,``Metalclad`s claim charges that Mexico has unlawfully expropriated it`s hazardous waste landfill in the community of Guardalcazar and in further violation of NAFTA, has failed to accord Metalclad fair and equitable treatment in accordance with international law as well as due process, all of which entitles Metalclad to damages equal to the projects fair market value which is estimated to be in excess of $50 million.``
