VSEA's Person Most Knowledgeable testifies re: damages which are the basis of the Varian SLAPP against message board posters after 782 days of litigation and millions in attorneys fees:
WIDMANN: Okay. Now, since you're the designated person most knowledgeable, what are you here most knowledgeable about from the category set forth in Exhibit 11?
POPPE: The categories are set forth basically in this one paragraph that extends from page 1 to page 2.
FELCH: The amount of damages.
WIDMANN: The amount of damages set --
FELCH: Sustained by Varian Semiconductor Equipment.
WIDMANN: Okay. Any of the other corporate defendants?
FELCH: No.
WIDMANN: What are the amount of the damages it sustained?
FELCH: As of Tuesday, March 27, 2001, it came to $38,000 -- $38,947.
WIDMANN: What are you referring to, ma'am?
FELCH: Lost work time for various employees.
...
FALCON: And I see nowhere on Exhibit 13 any damages for depressed stock value or market valuation.
FELCH: That's correct.
FALCON: And I see no damages here from any loss of revenue for unfair competition. Are you claiming unfair competition as damages in this lawsuit?
FELCH: Not as damages, no.
